Terms of Use

This is a legal agreement ("Agreement") between ("you") the user and "eSurfr.com", which will apply to you in respect of any and all services offered by or acquired from the eSurfr.com web site. Upon successful registration, you become a member of eSurfr.com and you agree to be bound by all of the terms and conditions of this agreement for as long as you remain a Member, in addition to our Privacy and other terms and conditions posted on the Site from time to time. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT PROCEED TO REGISTER TO BECOME A MEMBER OF THE SERVICE.

Validity period
This agreement is valid, as long as you are a member/ use the services offered by eSurfr.com. eSurfr.com may deny/terminate your access to the Site and/or your membership for any reason with an email notice to you, provided by you. You may also discontinue/terminate your membership at any time, for any reason by intimating eSurfr.com. If your membership is terminated by eSurfr.com for breach of agreement, you will not be entitled to any refund on any kind of charges paid.

Content Posted on the Site
You understand and agree that eSurfr.com may delete any content, messages, photos or profiles (collectively, "Content") that in the sole judgment of eSurfr.com violate the Terms of Use or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of other eSurfr.com and/or its Members.

You are solely responsible for the Content that you publish or display or post on eSurfr.com service, or transmit to other eSurfr.com Members. eSurfr.com reserves the right to verify the authenticity of Content posted on the site. In exercising this right, eSurfr.com may ask you to provide any documentary or other form of evidence supporting the Content you post on the site. If you fail to produce such evidence, eSurfr.com may in its sole discretion, terminate your Membership.

By posting Content to any public area of eSurfr.com, you automatically grant, and you represent and warrant that you have the right to grant, to eSurfr.com, and other eSurfr.com Members, an irrevocable, perpetual, non-exclusive, fully-paid, worldwide license to use, copy, perform, display, and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sublicenses of the foregoing.

The following is a partial list of the kind of Content that is illegal or prohibited on the Site. eSurfr.com will investigate and take appropriate legal action in its sole discretion against anyone who violates this provision, including without limitation, removing the offending communication from the Service and terminating the Membership of such violators.

It includes Content that:

is patently offensive to the online community, such as Content that promotes racism, bigotry ,hatred or physical harm of any kind against any group or individual;

Harasses or advocates harassment of another person;

promotes information that you know is false, misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;

Involves the transmission of "junk mail", "chain letters," or unsolicited mass mailing or "spamming";

Promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;

Contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page) ;

Provides instructional information about illegal activities such as violating someone's privacy, or providing or creating computer viruses;

Provides material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under 18;

Obscene/Pornographic/Vulgar pictures or textual material uploaded in the profile and/or transmitted in the E-mails and online chat.

Solicits passwords or personal identifying information for commercial or unlawful purposes from other users.

You must use eSurfr.com Service in a manner consistent with any and all applicable local, state, and federal laws and regulations.

Member Disputes
You are solely responsible for your interactions with other eSurfr.com Members. You agree and undertake that your interactions with the other eSurfr.com Members is at your sole discretion and responsibility, and that eSurfr.com shall notbe responsible/ liable for confirming the veracity of the content of other eSurfr.com Members.

Privacy
eSurfr.com will not intentionally monitor or disclose any private data unless required by law, enforcement agencies, regulation or court order. You agree to respect the privacy and confidentiality of others. In addition, eSurfr.com may on its own or as may be directed, provide any information required to the law enforcement authorities for any above wrongful usage. Governed by Privacy policy of eSurfr.com.

Indemnification
You agree to defend, indemnify and hold harmless eSurfr.com, its employees, directors, officers, agents and their successors and assigns from and against any and all liabilities, damages, losses, costs and expenses, including attorney's fees, caused by or arising out of claims based upon the use of your account and contravention of any terms and conditions herein for availing of this service, including any claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other members and infringement of intellectual property or other rights.

Disclaimer Policy
eSurfr.com is not responsible for any incorrect / inaccurate Content posted on the Site or in connection with the eSurfr.com Service, whether caused by Users, Members or by any of the equipments or programming associated with or utilized in the Service, nor for the conduct of any User and/or Member of the eSurfr.com Service whether online or offline. Under no circumstances will eSurfr.com be responsible for any loss or damage resulting from anyone's use of the site or the service and/or any content posted on the eSurfr.com or transmitted to eSurfr.com members. The exchange of profile through or by eSurfr.com site should not in any way be asumed as any offer and/or recommendation from/by eSurfr.com.

Miscellaneous
This agreement will be governed by and construed in accordance with the laws. If any provision of this Agreement is held to be invalid, the remaining provisions shall be enforced.

Registered members of this site would receive emails pertaining to the services offered by the site.

By registering on eSurfr.com, you agree that you have read the above terms, and would abide to these terms of use/agreement.
